Terms of service

These terms are the agreement between you and Noew B.V. for your use of the Noew app and your Noew account. Please read them before you use Noew.

1. Who we are and what these terms cover

Who we are: Noew is operated by Noew B.V., Leidseplein 12, 1017 PT Amsterdam, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 42156733. You can reach us at support@noew.co.

What these terms cover:

the Noew app for iPhone and Apple Watch
your Noew account
the app subscription you buy in the app

They also apply to your use of the app if you have Noew Plus.

What they don't cover: buying products in our web shop at noew.co.

Privacy: our Privacy Notice explains how we use your personal data. It is a separate document and not part of these terms. Where Noew needs your consent to use your data, for example your health data, we ask for it separately in the app.

Accepting these terms: you accept them when you create your account.

2. Who can use Noew

You must:

be at least 16 years old;
live in the European Union or the United Kingdom.

Your account: an account is for one person. Don't share it or use Noew on someone else's behalf.

3. What Noew does

What Noew reads: health and activity data from Apple Health, with your permission, plus the answers you give and what you log.

What it does with that data:

calculates your Recovery, Sleep, Strain and Energy scores;
forecasts your energy through the day;
estimates which nutrients your days may be using up;
recommends Noew sachets and when to take them;
sends notifications about these.

If you choose, it also uses your Google or iCloud calendar to take account of busy days.

How well it works for you depends on your data:

Some scores need data that only an Apple Watch records, such as heart rate variability.
If you use another device, or don't wear a watch, some scores may not be available.

4. Noew is not medical advice

Noew is a wellness product, not a medical device. It does not diagnose, treat, cure or prevent any disease or condition.

Treat scores as estimates: scores, forecasts and recommendations are general information based on your data. They can be wrong, for example when your devices record inaccurate or incomplete data.

Don't use Noew instead of a doctor:

Always ask a doctor or other qualified health professional about any medical question.
Never ignore professional medical advice or delay seeking it because of something in Noew.

Check with your doctor first before using Noew or taking supplements if any of these apply:

you take medication;
you have a health condition;
you are pregnant or breastfeeding.

In an emergency, call 112 (or 999 in the UK).

5. Supplements

Recommendations are general: Noew's sachet recommendations are general in nature. Noew doesn't know your full medical history, allergies or the medicines you take.

It's your responsibility to:

read the label of every product;
check that it's suitable for you, including allergens and possible interactions with medicines;
follow the recommended daily dose on the label.

Use supplements safely:

Food supplements should not be used as a substitute for a varied and balanced diet and a healthy lifestyle.
Keep them out of the reach of young children.

6. Your account

What you agree to:

Give accurate information and keep it up to date.
Keep your sign-in details secure.
Tell us straight away at support@noew.co if you think someone else has used your account.

If your account may be compromised, we may suspend it to protect you.

7. The app subscription

How it's bought: the app subscription is a monthly subscription bought through Apple's App Store.

Price and free month:

The price is shown in the app before you buy.
If Apple confirms you are eligible, your first month is free. Apple decides eligibility, which is usually one free trial per Apple ID.

Payment and renewal:

Payment is taken from your Apple ID account when you confirm the purchase, or when the free month ends.
The subscription renews automatically each month unless you cancel at least 24 hours before the end of the current period. Your Apple ID account is charged for each renewal.

Cancelling:

Manage or cancel your subscription in your Apple ID settings, or from the app's subscription screen.
Deleting the app or your Noew account does not cancel your subscription.

Apple's terms: Apple handles billing for App Store purchases under its own terms, including refunds and the right of withdrawal for consumers in the EU and UK. Ask Apple for any refund.

Noew Plus: Noew Plus is a membership that includes sachets and is sold on noew.co. You manage it from your noew.co account. When your noew.co account is linked to your Noew account, the app recognises your membership.

8. Referrals and credits

What credits are:

If you take part in our referral programme, you may earn credits.
Credits can be spent only in the noew.co shop.
They have no cash value and can't be exchanged for money or transferred to someone else.

When credits expire:

Credits expire 60 days after they are issued, unless we tell you otherwise when you earn them.
Credits that come with a Noew Plus period expire at the end of that period.
Unused credits are lost when your account is closed.

If we suspect misuse, we may cancel credits or referrals obtained through fraud, fake accounts or other abuse.

Changes to the programme: we may change or end the referral programme, but credits you have already earned keep their value until they expire.

9. Services from other companies

Noew depends on services from other companies:

Apple Health, Apple Watch and the App Store;
Google Calendar and iCloud Calendar, if you connect them;
Shopify, for our web shop;
Clerk, for sign-in.

Their availability is not in our control. Your use of them is subject to their own terms.

Apple's licence for the app: your licence to use the app downloaded from the App Store is granted under Apple's standard Licensed Application End User License Agreement (https://www.apple.com/legal/internet-services/itunes/dev/stdeula/). These terms apply alongside it.

10. Using Noew fairly

Please don't:

copy, decompile or reverse engineer the app or our services, except where the law allows it;
access Noew by automated means such as bots or scrapers;
interfere with or try to get around Noew's security, the referral programme or credits;
use Noew for anyone other than yourself, or for any unlawful purpose.

11. Intellectual property and your data

What we own: the app, our scores, models, designs, text and other content. You may use them only for your own personal use of Noew.

What you own: your data.

You give us permission to use it only to provide Noew to you, as described in our Privacy Notice.
That permission ends when you delete your account, except for what we must keep by law.

12. Availability and changes to Noew

Availability:

We work to keep Noew available, but we can't promise it will always be available or free of errors.
We may need to pause it for maintenance or reasons outside our control.

Changes to Noew:

We may change Noew, for example to improve it or to comply with the law.
If a change materially reduces what you've paid for, we'll tell you in advance, and you can cancel.

13. Ending your use of Noew

You can stop using Noew at any time and delete your account in the app (Profile → Delete account). Remember to cancel any App Store subscription separately.

When we may suspend or close your account:

if you seriously or repeatedly break these terms;
if the law requires it;
if we stop offering Noew.

We'll tell you why and, where possible, give you notice first. If we stop offering Noew, we'll give you reasonable notice.

What happens to your data: when your account is closed, we deal with your data as our Privacy Notice describes.

14. Our responsibility to you

What we are responsible for: loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill.

What we are not responsible for:

loss or damage that was not foreseeable;
business losses, because Noew is for personal use only;
loss caused by services from other companies, or by inaccurate data from your devices.

What these terms never limit:

your statutory rights as a consumer;
our liability where the law doesn't allow it to be limited, such as for death or personal injury caused by our negligence, or for fraud, intent or gross negligence.

15. Changes to these terms

Notice:

We may update these terms, for example when Noew changes or the law changes.
If a change is important, we'll tell you at least 30 days before it takes effect, in the app or by email.

If you don't agree: you can stop using Noew and cancel before the change takes effect.

Your consents: changes to these terms never change the consents you have given us for your data. If we need a new consent, we'll ask you separately.

16. Law and disputes

Governing law: Dutch law applies to these terms.

Consumer protections: if you are a consumer living in another EU country or in the UK, you also keep the protection of the mandatory laws of your country.

Where disputes go:

If something goes wrong, please contact us first at support@noew.co, and we'll try to solve it.
Disputes can be brought before the competent court in the Netherlands.
Consumers can also bring a claim in the courts of the country where they live.
